Terms of Use for Linkie.to

These Terms of Use ("Terms") govern your access to and use of the Linkie.to website, platform, and services (collectively, the "Service") provided by Linkie.to ("Linkie.to," "we," "us," or "our"), a company based in Croatia.

By creating an account or using our Service, you agree to be bound by these Terms.

1. Your Account

Eligibility: You must be at least 13 years old (or 16 in the European Union) to use the Service.

Account Security: You are responsible for safeguarding your account login details. You must notify us immediately at support@linkie.to of any unauthorized use of your account.

Account Responsibility: You are solely responsible for all activity that occurs under your account.

2. Paid Services

We offer optional "Free" and paid "Pro" subscription plans.

Billing:"Pro" plans are billed on a monthly or annual subscription basis. Payments are processed by our third-party payment processor, Stripe.

Renewals: Subscriptions automatically renew unless you cancel your plan before the end of the current billing period.

Refund Policy: We offer a refund on subscription payments if you request one at support@linkie.to within 24 hours of the subscription purchase or renewal. After 24 hours, payments are non-refundable.

3. Native Commerce

We provide tools for Pro users to sell digital products and collect tips directly from their profiles ("Native Commerce"). The terms in this Section 3 apply to anyone who uses Native Commerce, whether as a seller or as a buyer.

Eligibility:Native Commerce is available only to users on an active "Pro" subscription. To accept payments, you must complete Stripe Connect Express onboarding and have charges enabled on your Stripe account. If your Pro subscription ends or your Stripe account becomes restricted or disabled, your commerce components will stop accepting new purchases.

Platform Fees: By using Native Commerce, you agree that Linkie.to will deduct a 5% platform fee from each transaction. This fee is in addition to any processing fees charged by our third-party payment processor, Stripe. The platform fee is non-refundable, including in the event of a refund, return, chargeback, or dispute.

Payment Processing & Stripe Agreements: All commerce payments are processed via Stripe Connect Express. By using Native Commerce as a seller, you agree to the Stripe Services Agreement and the Stripe Connected Account Agreement. Stripe handles identity verification, payouts, and the seller dashboard. You are responsible for keeping your Stripe account in good standing.

Merchant of Record:The seller is the merchant of record for every transaction. Linkie.to acts as a technology provider that facilitates the sale; we are not a party to the transaction between buyer and seller. The seller's name (or trading name) appears on the buyer's statement, and the seller is legally responsible for the goods or services sold.

Supported Regions & Currencies: Native Commerce currently supports sellers based in the United States, United Kingdom, Canada, Australia, and Ireland. Transactions can be priced in USD, EUR, GBP, CAD, or AUD. We may add or remove supported regions and currencies at any time.

Digital Product Delivery:Sellers may distribute either uploaded files (up to 500 MB per product) or a "gated" URL revealed only after purchase. For file products, buyers receive a private download link that expires 30 days after purchase and is limited to 5 successful downloads. Linkie.to is not obligated to extend, reissue, or restore expired or exhausted download links, except where required by law.

Seller Obligations: If you sell on Linkie.to, you agree to (a) accurately describe your products and prices, (b) deliver the digital product or gated URL as described, (c) provide reasonable buyer support for issues such as broken files or incorrect URLs, (d) honor any refund policy you publish, and (e) not engage in bait-and-switch, drop-shipping of physical goods, or any other practice prohibited by these Terms or by Stripe.

Taxes: You are solely responsible for determining, collecting, reporting, and remitting any applicable sales tax, VAT, GST, or other taxes to the appropriate authorities. Linkie.to does not currently collect or remit sales tax on your behalf.

Refunds, Chargebacks & Disputes:Refunds for products or tips are at the sole discretion of the seller and must be issued through the seller's Stripe Express dashboard. Chargebacks and disputes raised by buyers are handled directly between the buyer, the seller, and Stripe; the seller is financially responsible for any chargeback amount, dispute fee, or reversal. The Linkie.to 5% platform fee is not returned in any of these scenarios.

Prohibited Commerce Content: In addition to the categories listed in Section 5, you may not use Native Commerce to sell, advertise, or solicit payment for content related to gambling, adult services, weapons, illegal drugs, counterfeit goods, financial scams, hateful content, or malware. We automatically scan product titles, descriptions, gated URLs, and tip messages against these categories at the time of creation, edit, and checkout. Matches will block the listing or the purchase.

Enforcement: We may pause, hide, or remove any commerce component, disable new purchases, or terminate your account if you violate these Terms, if Stripe restricts or revokes your account, or if we receive a credible report of fraud, infringement, or abuse. Where required by law, we will cooperate with payment processors and law enforcement.

4. User-Generated Content

You are responsible for the links, text, images, and other information you post on your Linkie.to profile ("User Content").

You Own Your Content: We do not claim ownership of your User Content.

License to Us: By posting User Content, you grant Linkie.to a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

Your Responsibility: You represent and warrant that you own or have the necessary rights to all your User Content and that its use does not violate these Terms or infringe on the rights of any third party.

5. Prohibited Content and Conduct

You agree not to post User Content or use the Service in any way that violates these prohibited content categories. Violations may result in immediate suspension or termination of your account without notice.

5.1 Child Safety

We maintain a zero-tolerance policy for:

  • Child sexual abuse material (CSAM)
  • Content that sexualizes, grooms, or solicits minors
  • Content that harms, endangers, or exploits children
  • Content targeting minors that is inappropriate, unsafe, or exploitative

5.2 Self-Harm and Dangerous Content

You may not post content that:

  • Promotes, encourages, or idealizes suicide or self-mutilation
  • Glorifies or encourages disordered eating or eating disorders
  • Provides instructions or methods for self-harm

5.3 Regulated and Illegal Goods & Services

You may not use the Service to sell, advertise, or facilitate the sale of:

  • Weapons, firearms, ammunition, and weapon accessories
  • Full-service sex work or prostitution
  • Illegal drugs, controlled substances, or drug paraphernalia
  • Gambling services (fantasy sports being an exception)
  • Any goods or services that are illegal in your jurisdiction

5.4 Adult Content Restrictions

While we allow links to adult content when properly flagged (see Section 6), you are prohibited from:

  • Uploading adult content, nudity, or sexually explicit material to your profile picture or background images
  • Advertising or linking to full-service sex work
  • Posting any content involving minors in sexual or suggestive contexts

5.5 Spam, Scams, and Fraud

You may not:

  • Create sites that collect personal information under false pretenses or fraudulent claims
  • Create multiple accounts for the primary purpose of advertising or generating affiliate revenue through deceptive means
  • Distribute spam, "junk mail," unsolicited commercial messages, or chain letters
  • Link to malware, viruses, phishing sites, or other malicious code
  • Engage in any fraudulent, deceptive, or misleading practices

5.6 Harmful Medical Information

You may not post content that:

  • Suggests harmful alternatives to evidence-based medical treatment
  • Falsely exaggerates the effects or severity of medical conditions
  • Provides dangerous medical advice that could cause harm to individuals
  • Promotes unproven or dangerous "cures" or treatments

5.7 Privacy Violations and Harassment

You may not:

  • Share others' personal information (such as addresses, phone numbers, or private documents) without their explicit consent (doxxing)
  • Impersonate any person, entity, or organization in a misleading or deceptive manner
  • Engage in harassment, stalking, intimidation, threats, or bullying
  • Promote violence or hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

5.8 Intellectual Property Violations

You may not:

  • Infringe on any third party's copyright (including unauthorized distribution of copyrighted content)
  • Infringe on any third party's trademark rights
  • Post content that violates any other intellectual property rights

Enforcement: We reserve the right to investigate any suspected violations of this policy. Violations may result in content removal, account suspension, or permanent termination without prior notice. In cases involving illegal content (such as child exploitation material), we will report violations to appropriate law enforcement authorities.

6. Sensitive Content Flagging

We allow links to sensitive content, including adult content, sexually explicit material, or other content that may not be appropriate for all audiences, provided you adhere to the following requirements:

Required Flagging:You must correctly flag individual links containing sensitive content using the "Mark as sensitive content" option when creating or editing links. This flag presents a warning to visitors before they access the linked content.

Important Distinction: While you may link to adult content (when properly flagged), you may not upload adult content, nudity, or sexually explicit images to your profile picture, page backgrounds, or any other visual elements of your Linkie.to profile itself.

User Content Responsibility: Linkie.to is not responsible for any content posted by users. Users are solely responsible for ensuring their content complies with applicable laws and these Terms. We do not monitor, review, or endorse user-generated content.

Violations: Failure to properly flag sensitive content is a direct violation of these Terms and may result in the suspension or termination of your account.

7. Termination

By You: You may terminate your account at any time by deleting it from your Account Settings.

By Us: We reserve the right to suspend or terminate your account and access to the Service for any reason or no reason, with or without notice, at our sole discretion. This includes, but is not limited to, violations of these Terms (especially the Prohibited Content and Conduct policies).

8. Disclaimers and Limitation of Liability

"AS IS" Service:The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied.

Limitation of Liability: To the fullest extent permitted by law, Linkie.to (and its affiliates, officers, and employees) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Service; (b) any unauthorized access to your account; (c) any User Content or conduct of any third party on the Service.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Croatia, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts located in Croatia.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice (e.g., by updating the "Last Updated" date or sending an email). Your continued use of the Service after such notice constitutes your acceptance of the new Terms.
